Abbott Blocks Access to Records with Billionaire Elon Musk
Texas Governor Greg Abbott (R) faces intense scrutiny over his private communications with tech mogul Elon Musk, as Democratic challenger Gina Hinojosa files a lawsuit demanding access to over a thousand unredacted pages of state correspondence. The dispute occurs just days before early voting begins for the November 3 election, underscoring the intense political pressure surrounding the governor’s tenure and the expanding influence of billionaires in Texas politics.
The Lawsuit and Public Records Dispute
State Representative Gina Hinojosa (D), whose term ends in January, has sued Abbott in Travis County, seeking an immediate ruling that she is entitled to the records. Hinojosa argues that the relevant communications bear directly on many matters within the Legislature’s responsibility, including state incentives, state grants, broadband deployment, public beach access, environmental impact, artificial intelligence, and data center development. She submitted her initial records request on September 29 and offered Abbott until October 13 to let her inspect the materials.
While Hinojosa acknowledges she may be legally prohibited from publicly releasing the contents of the materials—which she would only obtain through her role as a lawmaker—she maintains her right to inspect them is paramount. Her legal representation includes firms Feldman and Feldman PC and Herring & Panzer LLP. The case, Hinojosa v. Abbott, Tex. Dist. Ct., No. D-1-GN-26-010394, was filed on Monday, October 19, 2026.
Political Reactions and Early Voting Dynamics
Abbott’s office has refused to hand over the unredacted pages, citing disclosure exceptions that include the information being “intimate and embarrassing.” In a statement, Abbott’s press secretary, Andrew Mahaleris, characterized the lawsuit as “baseless and nothing more than an act of desperation,” accusing Hinojosa of abusing her office “to generate headlines for political purposes.”
Despite lacking Abbott’s vast campaign war chest, Hinojosa is polling near even with the three-term incumbent in a deeply red Texas race that appears increasingly competitive. The timing of the legal filing, occurring on the first day of early voting, adds significant weight to Hinojosa’s challenge and highlights the stakes of the upcoming gubernatorial contest.
Musk’s Deep Entanglement with Texas
The controversy underscores the deep entanglement between Abbott and Musk. Musk, the world’s richest person, has chosen Texas as the headquarters or corporate home for much of his business empire, including SpaceX, Starlink, Tesla, X, and the Boring Company. Abbott has frequently appeared alongside him at public events, and in May, Musk donated $500,000 to Abbott’s reelection campaign. In September 2021, Abbott stated publicly he spoke with Musk “frequently.”
A prior request by the Texas Newsroom to Abbott yielded 1,374 pages of documents, but all but 200 were heavily redacted or completely blacked out under similar disclosure exemptions, sparking earlier calls for transparency from watchdog groups. Hinojosa’s demand mirrors this largely unsuccessful previous effort, pushing the issue into the spotlight as the November 3 election approaches.
